Terms of Use

1. Parties

These Terms of Use are between PROCUX Technology Inc. (Technopark der Universität Ege, İnci-Gebäude, Nr. 103, Bornova, İzmir, Türkei; "Aircux", "we") and the natural or legal person using the service ("User", "you"). "Aircux" is the trade name of the growth and revenue intelligence service offered by PROCUX Technology Inc..

2. Service description

Aircux is a SaaS (software as a service) offering that brings together the signals from a business's connected channels (website, social media, marketplace, messaging, search) in a single backbone, prepares growth work such as content, support, loyalty and attribution, and routes every external action through user approval (the "approval gate"). The service is continuously developed; features may be added or changed over time.

3. Subscription and billing

• The service is subscription-based. The Cloud Starter plan has a fixed monthly fee; the early access price stays fixed for 12 months.
• Fees are charged in the amount and currency shown on the pricing page (pricing); applicable taxes may apply.
• The subscription renews automatically at the end of each period unless cancelled. The Refund Policy governs cancellations and refunds.

4. Payment — merchant of record

Payment and invoicing are carried out through Paddle.com Market Ltd as merchant of record. Paddle is the party that issues the invoice and collects payment for your purchase; Paddle's buyer terms also apply. Refunds are also processed through Paddle.

5. Acceptable use

• You use the service only in compliance with applicable law and the rights of third parties.
• Spam, misleading content, unlawful data processing, reverse engineering, overloading the service or circumventing security measures are prohibited.
• You warrant that you hold the authorisations and consents required to process the data in the channels you connect; you are the data controller for that data and Aircux acts as data processor (see the Data Processing Agreement).

6. Intellectual property

All intellectual property rights in the Aircux software, trademarks, design and content belong to PROCUX Technology Inc.. You are granted a non-transferable, non-exclusive licence to use the service for the term of the agreement. Your data belongs to you and you can export it with a single command.

7. Limitation of liability

To the maximum extent permitted by applicable law, the service is provided "as is". Aircux is not liable for indirect, incidental or consequential damages. Aircux's total liability is limited to the subscription fees you paid in the twelve (12) months before the claim arose. This limit does not cover liability that cannot be limited by law.

8. Governing law and disputes

These terms are governed by the laws of the Republic of Türkiye. Gerichte und Vollstreckungsbehörden von İzmir, Türkei have jurisdiction over disputes. The rights of users acting as consumers under applicable consumer law are reserved.
